Subject:Next White, apartments 16-11 and 16-12: questions

Note:

The address g.magularia@nextgroup.ge was given to me by Gvantsa Lomadze, Next's corporate lawyer, implying he is, or can contact, the Chief Legal Officer. Sopia Chelidze and Tamar Tsulukidze appear on LinkedIn as part of Next's legal team. Kakha Devadze appears in the media as the founder of the Next Group and as its CEO. The addresses of these three individuals were guessed by the pattern set by the addresses of Next's other staff; the emails were accepted by Next's domain nextgroup.ge.

Dear Mr Devadze, Ms Chelidze, Mr Magularia and Ms Tsulukidze,

I write to the four of you together because I need to know whether what follows is the policy of the Next Group or the conduct of one director.

I am the registered owner of apartments 16-11 and 16-12 at Next White, 27 David Mamuladze Street, Batumi, since November 13, 2024. My titles carry no encumbrance; Next's own lawyer confirmed this in writing on July 7, 2026. They also state I co-own the common property, which includes the elevators.

On July 1, 2026, under Levan Otarishvili's direction and without consulting the owners, Next Hospitality LLC activated a chip-access system on those elevators.

Until October 21, my chips were conditioned on signing a one-page document whose text has the parties confirm "that it contains no ambiguous provisions and they have no claims against each other." Next confirmed in writing that the document waives nothing, and declined in writing to delete the sentence.

Since July 1, and still today, Next enforces against me a debt it set itself. There is no contract: it rests on two drafts sent to me on January 28, 2026, dated November 13, 2024, and August 1, 2025, one citing a passport number issued after the date it bears, both of which I refused to sign. There is no account: no statement of the common expenses has ever been provided. There is no identified basis: my written requests of July 4, August 11 and October 26 asked for one and received none. On October 21, Next's manager wrote that my chips "will be activated once the outstanding debt has been paid".

On September 30, 2025, Next wrote on the official owner's chat:

"To avoid the implementation of a chip-access system in the elevators and to maintain the comfort of our building, we kindly ask you to settle any outstanding debts in a timely manner."

Mr Otarishvili has written to me once, on August 17. He stated that the system is "implemented for security purposes"; that chips "have been and continue to be provided to apartment owners free of charge"; that the signature requested of me "was related to confirming the receipt of the access chip/chips"; and that the company was "ready to continue discussing the matter in a professional and constructive manner". However, each of these statements is contradicted by Next's own written record: the announcement of September 30 above, a written statement by a manager on July 3, the two contract drafts of January 28, and the message of October 21. I answered Mr Otarishvili point by point on August 18. He has not written since. The period I set expired on August 25 without a response.

On October 26 I put six questions to him, with fourteen days to answer. Nothing has come back yet; the period expires on November 9.

So I ask you, as the people above him, the same six questions:

  1. Is the purpose of the elevator access-control system the collection of debts?
  2. What is the basis, in contract or in law, of the debt Next charges me?
  3. Where do you disagree with my analyses of this conduct (see below) under Articles 360 and 150 of the Criminal Code of Georgia, and on what reasoning and evidence?
  4. Why did Next drop the requirement to sign the Act of Handover on October 21?
  5. Will Next stop conditioning my use of property I co-own, yes or no?
  6. Will Next remove the access-control system, yes or no?

And one more, which only you can answer:

  1. Is the conduct described above the position of the Next Group, or that of Mr Otarishvili?

As of today, my wife and I have been without elevator access to our own recently renovated home for 122 days. We left Georgia on July 9 and cannot return to our home.

Everything above is documented, with Next's own messages, the contract drafts, the registry extracts and the statutes, in English, Georgian, Russian and Portuguese: https://next-dossier.ar.io/

My analyses mentioned above are here:
https://next-dossier.ar.io/en/page/crimes.html

If anything in it is wrong, show me reasoning and evidence and I will correct it. This letter and any reply to it will be recorded there in full. I would appreciate an answer within fourteen days, by November 14. I am reachable at this address; I do not take calls or SMS.

Yours sincerely,

Luís Fernando Schultz Xavier da Silveira
